IN THE INTEREST OF JUSTICE HIGH COURT GRANTS PETITION AGAINST MP NSUBUGA

Busiro North MP Paul Nsubuga’s election will be challenged in court.

This was after The High Court in Kampala declined his plea to dismiss the petition filed by his challenger Edgar Lubadde.

Paul Nsubuga applied for dismissal of the case on 19th march arguing Lubadde’s petition fell outside the three days’ cap.

That premise gave Lubadde grounds to object to the petition citing the parliamentary elections Act failing to serve him the petition within the prescribed time.

However, Justice Winifred Nabisinde denied the plea on the merit of ‘interest of justice.

Lubadde in his petition contends that MP Nsubuga does not possess the requisite academic credentials desired of an Mp.

 Lubadde also challenges Nsubuga birth name from Mukalazi Peter to Nsubuga Paul

This further prompted Justice Nabisinde to summon Nsubuga’s biological mother to verify the Paternity of the son.

Meanwhile, earlier on the Judge blocked Lubadde from bringing in new evidence in the petition.

She dismissed it on account it wasn’t in the original suit.

Lubadde also cited forgery in nomination papers. The petitioner and the respondent are hopeful of a positive outcome.

The case returns on the 31st of this month for cross-examination of witnesses including Nsubuga’s biological mother.
